These terms apply to every offer by the trader and every distance contract concluded between the trader and a consumer in the UK. Before a contract is concluded, the consumer will be provided with a copy of these terms or access to them in a durable form.
Article 4: The Offer
Any offer will clearly state if it is subject to a time limit or special conditions. Descriptions will be accurate and images will be a fair representation.
Article 5: The Contract
The contract is concluded when the consumer accepts the offer and meets its conditions. For online purchases, the trader will confirm receipt electronically. If payment is made electronically, secure systems will be used. The trader may verify the consumer’s ability to pay before accepting the order. At the latest upon delivery, the trader will provide:
- Contact address for complaints
- Conditions for exercising the right to cancel
- Warranty and after-sales information
- Total price including VAT and delivery costs
- Duration of the contract and termination conditions
- The model cancellation form (Annex I)
Article 6: Right to Cancel
For most goods purchased online, consumers have a legal right to change their mind within 14 days and receive a refund. This 14-day period starts the day after the goods are received. Exceptions and limitations are detailed in Article 10.
Article 7: Customer Obligations in Case of Cancellation
Goods should be handled only to the extent necessary to establish their nature, characteristics, and functioning. If goods are handled beyond this, the consumer may be liable for a reduction in value.
Article 8: Exercising the Right to Cancel & Costs
To cancel, the consumer must inform the trader within 14 days using the model form or another clear statement. Goods must be returned within 14 days of notifying cancellation. The consumer pays the return postage unless the trader agrees to cover it.
Article 9: Trader Obligations in Case of Cancellation
The trader will refund all payments, including standard delivery costs, within 14 days of receiving returned goods or proof of return. Refunds will be made using the same payment method unless agreed otherwise.
Article 10: Exemptions from the Right to Cancel
The right to cancel does not apply to:
- Goods made to the consumer’s specifications or personalised
- Sealed goods unsuitable for return due to health or hygiene reasons, once unsealed
Article 11: Price
Prices include VAT and are in pounds sterling (GBP). Prices will not be changed after an order is placed except as allowed by law.
Article 12: Contract Fulfilment & Guarantee
The trader guarantees goods will be as described and fit for purpose. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. If goods are faulty, the consumer has the right to repair, replacement, or refund within the applicable statutory timeframes.
Article 13: Delivery & Implementation
Orders will be delivered within 30 days unless otherwise agreed. If delivery is delayed or impossible, the consumer may cancel the contract and receive a refund. Risk passes to the consumer when goods are delivered.
Article 14: Payment
Unless otherwise agreed, payment must be made within 14 days of the contract being concluded. Where advance payment is required, delivery will not occur until payment is received. Late payments may incur interest and reasonable recovery costs.
Article 15: Complaints Procedure
Complaints should be sent promptly with full details. The trader will respond within 14 days. If a complaint cannot be resolved, disputes can be taken to the UK Retail Ombudsman or another ADR provider.
Article 16: Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Article 17: Additional or Different Terms
